Domestic Assault is Serious

The crime of domestic assault is taken quite seriously these days. So seriously that often a person is charged with domestic assault when one did not even take place.

Many times the police are called out of anger, frustration or revenge even though there has been no hitting pushing or shoving. One person in the relationship feels they are getting mistreated.  An argument starts. One of the parties feels the only way to win the argument is to call 911.

Once that happens, things can get ugly.

The police show up and depending on what they find things can escalate. That is when it is best to stay calm and not try to explain things away. If there is enough evidence in the mind of the police officer to execute an arrest, someone is going to jail.

If you do post bail before you get an attorney do not put off calling one and making an appointment. The earlier I get involved in these cases the better result I get for my clients. It is important that I know all the facts about the dispute and the other person involved as quickly as possible. Often, I can get in touch with them and they will tell me that they did not want an arrest to occur. They were just frustrated or afraid and felt they needed to call someone so they called the police. Many times they want to notify the prosecutor that they do not want to press charges.
