Why Were You Stopped?

First of all, what was the reason you were stopped? This can tell me a lot about what to look for next. Were you stopped for weaving, failure to maintain a single lane, speeding? Maybe you were only stopped because the officer said you did not having proper taillights. This is important.

Field Sobriety Tests

Did the officer administer the standard field sobriety test to you? Did he do them correctly? I have been through the same training as they have. I know how the tests should be done properly and as an experienced DUI attorney I know that a lot of times the tests are not given properly.

Statements

What statements did you make when you were interviewed. This can be very helpful. We don’t know that the officer claims until we get the police reports.

Breath Test

Then there is the question about the breath test? Did you take it? Was the breath test offered to you. Does the officer claim you refused?

If you took the test we follow one course of action. If you refused, we follow another. Both of these are designed to keep your driving privileges intact. One of the actions would be to request an administrative hearing. The other is to file an actual injunction against the Director of Revenue ordering him not to revoke your license.

Either way you only have fifteen days from the date of your arrest to take effective action.
